Hosting Terms of Services and Acceptable Usage Policy

As a Customer of Boroksite IT Solutions or Boroksite.com wherein refer to as Boroksite IT Solutions, you need to be aware that, when signing up for an account with Boroksite IT Solutions, you accept and agree to abide by our Web Hosting Terms of Service (this document). As a Customer of our Boroksite IT Solutions, you understand and agree also that it is beyond the power of Boroksite IT Solutions to restrict any public access to the data that you position on our servers and guarantee the security of your files. In this respect, you accept that it is your obligation to protect all the information that you make available to the wide internet public through our web hosting network and assume all responsibility for unveiling online personal data that could be abused.
 

All the sites and domain are prohibited that promote any illegal activity or present content that may be damaging to Boroksite IT Solutions' servers, or any other server on the Internet. Links to such materials are also prohibited.

1. Examples of unacceptable content or links:

A. Pirated software
B. Hacker programs or archives
C. Warez sites
D Pornographic materials
E. Anything that is against the rule of GOI and India IT Act 2000.

NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, AUDIO/VIDEO FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE.

2. Traffic or Bandwidth Usage
All account plans come with a legal unlimited amount of traffic allowance. Misuse of bandwidth will lead a client to be entitled for lesser bandwidth in future or account would be suspended or deleted. You are not allowed to host FREE HOSTING or provide free service to anyone what so ever.

3. IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

4. Server Abuse
Any attempt to undermine or cause harm to a server or customer of Boroksite IT Solutions is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund.  Web space must not be used by your visitor for free upload, download heavy size file. Web sites containing a large number of unlinked files or using server space for data storing propose are subject to deletion of files otherwise we will cancellation the account without prior notice.

5. Multi Domain Hosting
The clients can host only their own domains and websites under a shared Multi-Domain Web Hosting plan. Clients are not permitted to resell the webspace or Host other's websites under a shared hosting plan.

6. Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.

7. Refund Money
The provision of refund at Boroksite IT Solutions for any products is subjected to yearly payments only and will not refund for any other modes of payment, this offer is limited and may be not applicable always.

8. Account Deactivations
If we are not having customers correct contact detail and phone number then we reserve the rights to suspend and delete the account with out any intimation. Any account deactivated due to non-payment will require a reactivation fee.

9. Cancellation Refunds
Read clause 7.

10. Limitation of Liability
Boroksite IT Solutions shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Boroksite IT Solutions' servers going off-line or being unavailable for any reason whatsoever. Furthermore, Boroksite IT Solutions shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Boroksite IT Solutions' servers. All damages shall be limited to the immediate termination of service.

11. Violations
Violations of these Acceptable Use Policies should be referred to "legal [at] Boroksite IT Solutions". All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

12. Misbehaviour
If any client misbehaves or using abuse languages to our staff, then we will suspend or delete his account without any priority notice, and he will not get any refund and further support from us. We have full rights to take action against that client.

13. Downtime
If your site is down for any reasons more than 0.1% in a year, then you are liable to get 3 times more hosting period of downtime free of cost from us.

14. Backups and Data Loss
We strongly encourage all of our customers to do their own backups on their home computers or CDs to ensure you have ready access to your data in the event, we shall not be responsible for any claimed damages, including incidental or consequential damages of your backup files, lost websites, lost databases etc.

15. Disclaimer
Boroksite IT Solutions cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Boroksite IT Solutions are resold. Thus, certain equipment, routing, software and programming used by Boroksite IT Solutions are not directly owned or written by Boroksite IT Solutions. Moreover, Boroksite IT Solutions holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Boroksite IT Solutions sees fit. Unfortunately if website/server etc will down then we are not responsible for any losses faced by client.

Note: Boroksite IT Solutions reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification all the decision of Boroksite IT Solutions is final and binding.
